Malta Yacht Leasing

An individual who wishes to own a pleasure yacht, whether it is a new build or a pre-owned yacht, may benefit from a Malta yacht leasing set up alleviating the payment of VAT which may reduce it to an effective rate of 5.4%. By setting up a Maltese company, which then acquires the yacht, leases it to a third party and finally transfers the ownership of said yacht the payment of VAT is provided. Malta yacht leasing allows the lessor company to deduct any input VAT incurred on the purchase of the yacht by using it for an economic activity.

Guidelines to Malta Yacht Leasing

To benefit from the Malta yacht leasing scheme the owner only has to follow these following rules:

  • bringing the yacht to Malta, at the beginning of the lease agreement
  • as a first lease payment, the lessee needs to pay 40% of the yachts value to the lessor
  • the lease instalments are subject to the local standard rate of VAT at 18% and must be payable every month
  • the lease agreement must not exceed 36 months
  • the lessor has to be expected to make a profit from the leasing agreement above and beyond the yachts value
  • at the end of the lease agreement the purchase value shall not be less than 1% of the yachts original value, it will also be subject to the standard rate of VAT at 18% when the yacht returns to Malta and is sold thereupon
  • provided the lessee chooses to purchase the yacht at the end of the lease, a VAT paid certificate will be issued to the lessee as long as all VAT due has been paid

Malta Yacht Leasing in 3 Steps

1. Setting up a Maltese Company & Purchasing the Yacht

A Maltese company shall be set up with the object of owning and leasing the yacht. Said company shall obtain a VAT number, purchase and then lease out the yacht. Whether the yacht is bought from Malta or imported from outside or within the EU the VAT treatment on the purchase will be different.

2. Registering the Yacht

Registering a yacht in Malta is a very straight forward procedure. First an application for the yacht to be registered provisionally for six months is made to the Maltese registry. During this timeframe the yacht may use the Malta flag without any restrictions. During this timeframe the documents necessary for registration (either a bill of sale or builders' certificate and a deletion certificate) have to be handed over to the registry and an inspection has to be undertaken by a Malta Government Appointed Surveyor.

3. Leasing the Yacht

The owner of the Yacht, acting as the lessor will lease the yacht to the lessee in return for a consideration, when the yacht arrives in Malta. Therefore a lease agreement is drawn up. The company incorporated in Malta therefore has to be the owner of the yacht and the lessee can be any party. The malta yacht leasing agreement provides the lessee with the option of purchasing the yacht at the expiration of the lease agreement. Therefore the purchase price has to be 1% of the original value or higher.
