Commercial Yacht Registration

The Commercial Yacht Code, drawn up by the Merchant Shipping Directorate within the Authority for Transport in Malta in 2004 and revised in 2010 regulates which types of yachts can be registered as commercial vessels in the Republic of Malta. Commercial yacht registration generally applies for commercially used yachts which do not carry cargo, do not carry more than 12 passengers and are over 15m in length.

Malta Commercial Yacht Registration: The Procedure

At first a yacht is registered under the Malta flag provisionally for a period of six months. In order to do that the owner or an authorized representative needs to file in the following documents:

  • proof of qualification to own a Maltese ship
  • declaration of ownership made in front of the Registrar
  • payment of initial registration fees and annual tonnage tax
  • and where applicable: an application for Ship Radio Station Licence and a copy of the yacht's current International Tonnage Certificate

During the provisional registration the following documents need to be submitted to complete the commercial yacht registration:

  • either a bill of sale if there was previous ownership or otherwise a builder's certificate in the name of the applicant
  • evidence that the yacht has been marked in accordance with the law
  • a Certificate of Survey and where applicable a copy of the International Tonnage Certificate

Malta Commercial Yacht Registration: The Benefits 

The advantages of a commercial yacht registration in Malta include the following:

  • no Malta Tax is chargeable on the income derived from chartering of a commercial yacht. Just an annual tax that is calculated on the yacht's tonnage.
  • no Malta VAT is chargeable by the owner during the operation of the yacht if the lessee of said yacht uses it for an economic activity.
  • Input VAT incurred on goods and services attributable to the yacht owners chartering operations would be recoverable.
